II.2.4) Description of the procurement

North London Waste Authority (the Authority) is seeking a contractor to design and construct the following works:

(i) a resource recovery facility (RRF) incorporating a reuse and recycling centre and associated works. It includes design and construction of the following: recycling and fuel preparation facility (RFPF), a reuse and recycling centre (RRC), offices, and staff and visitor welfare facilities, odour abatement and dust suppression plant and equipment, fire control water tanks and pump house and equipment, surface water pumps, pipework and attenuation tanks, disabled parking, vehicle and cycle and pedestrian routes and weighbridges, landscaping;

(ii) a building to be known as EcoPark House comprising of a visitor, community and education centre for the wider community, office accommodation, a boat canopy and associated works including drainage, earthworks, fencing and lighting, and clearance of the wharf;

(iii) works to the existing utilities relating to the RRF and EcoPark House, laying and installation of new utilities and groundworks. These works include the relocation or decommissioning of existing and the laying of new pipes, cables and systems for portable water, wastewater, surface water, foul water, process water, electricity, gas, and CCTV, telecoms and data. It further includes 11kV ring main ducting and cabling;

(iv) other roads and hardstanding; and

(v) landscaping.

The Memorandum of information provides background information on the Authority and the North London Heat and Power Project (NLHPP). The works are on the critical path for the delivery of the NLHPP for the development of a replacement energy recovery facility and associated works at the Edmonton EcoPark pursuant to a development consent order (The North London Heat and Power Generating Station Order (2017/215) as amended) granted to the Authority on 24.2.2017. The site for the Works, Edmonton EcoPark, is an operational waste management site where London Energy Ltd, a private company wholly owned by the Authority, operates an existing Energy from Waste (EfW) facility. Normal operation of the EfW facility is to be maintained at all times during the construction.

III.2.2) Contract performance conditions

The Authority reserves the right to require deposits, guarantees, bonds or other forms of appropriate security. Tenderers should note that the contract includes a term requiring the successful tenderer to pay (and procure that its subcontractors pay) at least the London Living Wage to personnel working primarily at the site of the works. Tenderers should also note that the contract includes a term requiring the successful tenderer to provide a minimum of twenty (20) new apprenticeships, either as part of the successful tenderer's own corporate apprenticeship scheme or through a construction industry shared apprenticeship scheme. A contractual provision is also included to require the successful tenderer to provide twelve separate on-site skills training weeks to 5 different trainees each week.

III.1.1): tenderers should note that the contract is the NEC4 Option C contract with secondary option clause X22. As such it contains provisions for early contractor involvement and the works and services to be performed under the contract shall be split into 2 stages. Stage 1 will provide an opportunity for the successful tenderer to develop designs for the works in conjunction with the Authority. On the successful completion of the stage 1 activities and the agreement of prices for Stage 2, the Authority intends to (but is not bound to) instruct the successful tenderer to proceed to stage 2 which comprises design finalisation and construction of the works. Where the stage 1 activities are not successfully completed or the stage 2 prices are not agreed, the Stage 2 works and services shall be removed from the contract and the completion of stage 1 shall mark the completion of the activities to be performed under the contract. Both stages will (to the extent that the successful tenderer is instructed to proceed to stage 2) be performed under the same Contract.

III.1.3): tenderers should note that the Authority is requesting references to support certain responses to the selection questionnaire. Further details are set out in the selection questionnaire. Tenderers should note that the Authority intends to publish details of any contract awarded in accordance with the UK Government transparency policy, subject to possible redactions at the discretion of the Authority. The Authority reserves the right not to award the contract as a result of the procurement process commenced by the publication of this notice; and to make changes as it deems fit to the content and structure of the competition whilst ensuring compliance with the Public Contracts Regulations 2015 (SI 2015/102) and the EU Directives; and in no circumstances will the Authority be liable for any costs incurred by tenderers.
