Economic operators may be excluded from this competition if they are in breach of any of the situations referred to in regulation 58 of the Public Contracts (Scotland) Regulations 2015.

III.1.2) Economic and financial standing

List and brief description of selection criteria:

1) All candidates will be required to provide a statement, covering 3 previous financial years including the overall turnover of the candidate in respect of the activities which are similar type to the subject matter of the notice;

2) All candidates will be required to provide statement of accounts or extracts relating to their business. See contract/tender documentation which incorporates the requirements of the ESPD (Scotland) and the financial period of reporting is the previous 3 years.

III.1.3) Technical and professional ability

List and brief description of selection criteria:

‘Information and formalities necessary for evaluating if the requirements are met:

Lot 1: decontamination maintenance, testing and re-validation minimum standards.

1) Economic operators must issue and discuss maintenance and draft test reports before leaving the customers site;

2) Maintenance provision must be in line with manufacturers recommendations;

3) Testing and re-validation must be carried out to the validated cycle setup at time of purchase of the equipment.

4) Economic operators must confirm maintenance, testing and re-validation will comply fully with SHTM2010 and SHTM2030. 5) Economic operators must provide quarterly performance data to national procurement detailing; the number of fault calls, their causes, repair parts used, repair turnaround time, first time fix rate, parts used per repair and the number of maintenance and testing visits during the period;

6) Economic operators must provide details of all current service contracts held for equipment in NHS Scotland. Information must include; serial numbers, equipment model, location, service cover level, renewal date and annual cost;

7) Economic operators must provide spare parts pricing.

Lot 2: Decontamination chemicals minimum standards.

1) Economic operators must provide cosh data sheet for each chemical tendered;

2) Economic operators must provide a list of materials that are not compatible with tendered chemistries. This list must be provided for each chemical that is tendered.

Lot 3: Decontamination filters minimum standards.

1) Economic Operators must provide evidence to confirm that tendered products comply with HTM2030, or other relevant standards stated.’

Precise information on deadline(s) for review procedures:

Precise information on deadline(s) for lodging appeals: the authority will notify economic operators who submitted a tender or (where no deselection notification has previously been made) applied to be selected to tender, of its decision to award the framework agreement which notification will contain among other information, a summary of the reasons why the economic operator was unsuccessful. The notification will incorporate a ‘standstill period’ of a minimum of 10 clear calendar days (or a minimum of 15 if the communication method used is not electronic) between the date on which the authority despatches the notice(s) and the date on which the authority proposes to conclude the relevant framework agreement. The bringing of court proceedings against the authority during the standstill period will automatically continue the prohibition on entering into the framework agreement until the court proceedings are determined, discontinued or disposed of, or the court, by interim order, brings to an end the prohibition. The remedies that may be awarded by the courts before the framework agreement has been entered into include the setting aside of the decision to award the framework agreement to the winning tenderer(s). The bringing of court proceedings against the Authority after the framework agreement has been entered into will not affect the framework agreement unless grounds for the imposition of special penalties under the Public Contracts (Scotland) Regulations 2012 can be established. Otherwise the remedies that may be awarded by the courts where the framework agreement has been entered into are limited to the award of damages. Economic operators are entitled to write to the authority after receipt of the notification should they require further clarification.
