This lot is seeking the provision of a suitably permitted or licenced waste reception facility to receive bulky waste. The facility must be within 8 km of Dumfries town centre. Upon receipt of the waste the service provider must ensure that it is stored, transported, treated and disposed of properly and in accordance with all applicable laws, permissions, consents, licences, permits and the waste duty of care requirements. Deliveries to the reception faciity will include material collected by the Council's bulky collection service and/or skip services, including bulky and small mixed material aggregated at Household Waste Recycling Centres (HWRC) or other bulking point(s) in a mixed form. Material is likely to include large household or commercial items such as furniture, mattresses, carpets, mixed garden waste and items from DIY-type construction operations. Material may include arisings from building maintenance, housing clearance/refurbishment, roads, grounds maintenance, litter picking, flytipping, site clearance, country parks, education and other Authority services and commercial customers. Collection of bulked. Additional material arisings could include wood, plastic, metal, glass, tiles and ceramics.

We are seeking one facility within 8 km of Dumfries town centre and a separate facility within 30 km of Annan town centre. Upon receipt of the waste the service provider(s) must ensure that it is stored, transported, treated and disposed of properly and in accordance with all applicable laws, permissions, consents, licences, permits and the waste duty of care requirements. Deliveries to the reception faciities will consist of Inert Waste and/or Rubble and Soil. This lot is seeking the provision of a suitably permitted or licenced waste reception facility to receive wood waste. The facility must be within 8 km of Dumfries town centre. Upon receipt of the waste the service provider must ensure that it is stored, transported, treated and disposed of properly and in accordance with all applicable laws, permissions, consents, licences, permits and the waste duty of care requirements. This lot is for wood of varying types, but typically it will be unshredded. Material is likely to come predominately from household waste recycling centres and possibly other Council premises or operations. Material may be sorted or unsorted. There is no guarantee that waste wood will meet PAS104 or PAS111 standards. It is recognised therefore that both low grade, (suitable for some processing and power and heat generation) and high grade (as per PAS104) may be encountered. Materials likely to be included within scope are MDF, Chipboard, Plywood and/or Blockboard.

Street Sweepings – i.e. detritus from street sweeping operations deposited direct from the street sweeper vehicle or in a skip. III.1) Conditions for participation

III.1.1) Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers

List and brief description of conditions:

Hold any and all permits and licences and or, an ability to demonstrate any licence exemption, as required by the Pollution Prevention and Control (Scotland) Regulations 2012, the Waste Management Licensing (Scotland) Regulations 2011 (as amended) or the equivalent legislation in England and Wales, for all Waste Treatment facilities the bidder is offering, as issued by SEPA or their equivalent body in other jurisdictions. Details of the local environmental agency office that issued the licence(s) for the site or facility proposed should be provided.

III.1.2) Economic and financial standing

Minimum level(s) of standards required:

Public Liability of no less than Five Million pounds (5 000 000 GBP) in respect of each claim, without limit to the number of claims employers liability of no less than Ten Million pounds (10 000 000 GBP).

All Risk of no less than Five Million pounds (5 000 000 GBP).

Justification:

Due to the termination of Dumfries and Galloway Council's current Waste PFI contract normal procurement timescales are impractical to allow continued service delivery and to prevent issues to public health. As such the Council has opted to use the open accelerated procedure.

Precise information on deadline(s) for review procedures:

The Authority will notify economic operators who submitted a tender, of its decision to award the contract which notification will contain among other information, a summary of the reasons why the economic operator was unsuccessful. The notification will incorporate a “standstill period” of a minimum of 10 clear calendar days (or a minimum of 15 if the communication method used is not electronic) between the date on which the Authority dispatches the notice and the date on which the Authority proposes to make an award pursuant to this procurement. The bringing of court proceedings against the Authority during the standstill period will automatically continue the prohibition on entering into the contract until the court proceedings are determined, discontinued or disposed of, or the court, by interim order, brings to an end the prohibition. The remedies that may be awarded by the courts before the contract has been entered into include the setting aside of the decision to award the contract to the winning tenderer. The bringing of court proceedings against the Authority after the contract has been entered into will not affect the contract unless grounds for the imposition of special penalties under the Public Contracts (Scotland) Regulations 2015 can be established. Otherwise the remedies that may be awarded by the courts where the contract has been entered into are limited to the award of damages. Economic operators are entitled to write to the Authority after receipt of the notification should they require further clarification. The Authority will respond within 15 days of such a written request, but it should be noted that receipt by the Authority of such request during the standstill period may not prevent the Authority from awarding the contract following the expiry of the standstill period. Where an economic operator is dissatisfied with the Authority's response

To its request for clarification, or considers that the contract has been concluded in breach of The Public Contracts (Scotland) Regulations 2015, such economic operator is advised to promptly seek independent legal advice.
